These Terms govern your use of the website at
www.roboiq.com.au (the “Site”)
operated by RoboIQ Pty Ltd ABN 16 661 653 667 (“RoboIQ”, “we”, “us”). By
using the Site you agree to these Terms. If you don’t agree, please don’t
use the Site.

2. The Site is informational

The Site provides information about RoboIQ and our products and
services. Nothing on the Site constitutes an offer, advice or a
binding commitment. Engagements for paid Services are governed by a
separate written agreement signed by both parties.

3. Permitted use

You may browse the Site for personal, business or research purposes. You agree not to:

• use the Site in a way that violates any applicable law or regulation;
• attempt to gain unauthorised access to the Site, our infrastructure or our customers’ data;
• introduce malware, viruses or other harmful code;
• scrape, crawl or otherwise harvest content from the Site at a rate or volume that materially impacts performance for other users, except for legitimate search-engine indexing;
• use any automated tooling to submit forms or interact with our chat widget without our express written permission;
• resell or redistribute Site content as if it were your own.

4. Intellectual property

All content on the Site – including text, graphics, logos, images,
videos, audio and software – is owned by RoboIQ or our licensors and
is protected by copyright, trade mark and other intellectual property
laws. The “RoboIQ”, “RoboCRM”, “RoboPA”, “RoboOS” and related product
names and marks are trade marks of RoboIQ. You receive no licence to
any of these except the limited right to view the Site as intended.

5. User submissions

When you send us information through forms, the chat widget, email or
any other channel (“Submissions”), you confirm that the Submission is
yours to share, doesn’t infringe anyone’s rights, and isn’t unlawful or
defamatory. You grant RoboIQ a non-exclusive, royalty-free licence to
use the Submission for the purposes described in our
Privacy Policy and to follow up with you
about your enquiry.

6. Third-party links

The Site may link to third-party websites or services. We don’t control
those sites and aren’t responsible for their content, accuracy, security
or privacy practices. Following an external link is at your own risk.

7. Disclaimers

The Site is provided “as is” and “as available”. To the maximum extent
permitted by law, we make no representations or warranties of any kind,
express or implied, about the operation of the Site or the accuracy,
reliability or completeness of any information presented.

Nothing in these Terms excludes, restricts or modifies any consumer
rights you have under the Australian Consumer Law (Schedule 2 to the
Competition and Consumer Act 2010 (Cth)) where those rights
cannot lawfully be excluded.

8. Limitation of liability

To the maximum extent permitted by law, RoboIQ is not liable for any
indirect, incidental, special, consequential or punitive damages, or
for any loss of revenue, profits, goodwill, data or business
interruption, arising out of or in connection with your use of the
Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or in connection with the
Site is limited to AUD 100, except where a higher amount is required
by mandatory consumer protection law.

9. Indemnity

You agree to indemnify and hold RoboIQ, our directors, officers and
staff harmless from any claim, loss or liability arising out of your
breach of these Terms or your misuse of the Site.

10. Privacy

Our handling of personal information is described in our
Privacy Policy, which forms part of these
Terms.

11. Changes

We may update these Terms from time to time. The “Last updated” date at
the top of this page reflects the most recent change. Continued use of
the Site after changes are posted means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia.
The courts of New South Wales have exclusive jurisdiction to resolve
any dispute arising out of or in connection with these Terms.
